Terms of Service

These terms are a contract between you and TalkerLabs, Inc. ("TalkerLabs", "we", "us") for the Nolby website at www.nolby.com and the Nolby service. By messaging Nolby or buying a plan, you agree to these terms and to our Privacy Policy.

The service
Nolby is an AI assistant you use by message, including on WhatsApp and Telegram. It can draft, look things up, and take actions through tools you connect. Output can be wrong or incomplete. You decide whether to rely on it and whether to approve an action before it is taken.
Who can use Nolby
You must be at least 18. If you use Nolby for a company, you confirm you can bind that company to these terms.
Free token allowance
New users receive a token allowance at no charge and with no payment card. That allowance does not expire. The amount is 1,000 tokens today. We may change the amount for people who start after the change. A change does not reduce an allowance already granted.
Plans, tokens, and renewal
Paid plans are monthly subscriptions at the prices shown on www.nolby.com. A paid plan includes a token allowance for that billing period. You can buy extra tokens as a top-up. Some tokens may be granted as a reward. Each top-up or reward grant lasts until the expiry shown for that grant.
A subscription renews each month until you cancel. You can cancel from within the app, or by emailing hello@nolby.com. Cancellation stops the next renewal. You keep access for the period you already paid for. When that period ends, tokens that came with the plan end. Top-up tokens and reward tokens keep working until their own expiry.
We may change prices or plan contents. A price change applies to renewal periods that start after we post the new price.
Payment
Paddle is our merchant of record. Checkout, sales tax, and payment details are handled by Paddle. We do not store your full card number.
Refunds
You can ask for a refund by emailing hello@nolby.com within 14 days of a charge. We refund that charge only if none of the tokens from it have been used. If any of those tokens have been used, the charge is not refundable. This rule applies to a subscription charge and to a token top-up.
The free token allowance is not a purchase, and there is nothing to refund.
Refunds are made to the original payment method through Paddle.
Acceptable use
Do not use Nolby to break the law, to harm someone, to send spam, or to probe or disrupt the service or someone else's systems. Do not share your access in a way that lets others impersonate you. We may suspend or close access that violates these terms.
Your content
You keep your rights in what you send to Nolby. You give us permission to host, process, and transmit that material only so we can provide the service, secure it, and meet legal duties. How we handle personal data is described in the Privacy Policy.
Our intellectual property
Nolby, the site, and our branding belong to TalkerLabs or our licensors. These terms do not give you ownership of them.
Disclaimers
The service is provided "as is." We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose. AI output is not professional advice.
Limitation of liability
To the fullest extent the law allows, TalkerLabs is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data or goodwill. Our total liability arising out of the service in any twelve-month period is limited to the amount you paid us for the service in that period. If you have only used the free allowance, that amount is zero. Some places do not allow these limits. In those places, the limits apply only as far as the law allows.
Ending these terms
You may stop using Nolby at any time. We may stop providing the service, or suspend access, if you break these terms or if we must do so for security or legal reasons. Sections that by their nature should survive (including refunds already due, disclaimers, liability limits, and governing law) survive.
Changes
We may update these terms by posting a new version on this page and changing the date above. If you keep using Nolby after the new version is posted, you agree to it. If you bought a subscription, a material change to these terms applies from the next renewal unless a law requires otherwise.
Governing law
These terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Courts in Delaware have exclusive jurisdiction, except that either party may seek injunctive relief in any court that has jurisdiction.
